Affordable Housing & Preservation

Our firm helps organizations develop affordable housing policy that accounts for access, long-term affordability and the communities affected.

Policy for housing access and lasting affordability

An affordable housing policy needs more than a production target. It must address who can qualify, how residents find and apply for homes, how affordability is maintained and what happens when a building’s restrictions or public benefits change.

We work with community organizations, housing advocates and affordable housing entities on legal research, proposed legislation and preservation strategy. Topics can include access to affordable units, regulatory agreements, subsidy conditions, affordable homeownership and meaningful community participation in land-use decisions.

Experience with housing and land use

As a New York City Council Member and chair of the land-use subcommittee on planning and dispositions, Ben Kallos worked on affordable housing approvals, subsidies and regulatory agreements. His public record also includes efforts to improve access to affordable housing and preserve homes in his district.

Our affordable cooperative practice provides a related perspective on the consequences of regulatory terms for a building and its shareholders. Policy work considers both the public objective and how the proposed rules will operate over time.

How we work with housing organizations

The firm can review a proposed policy, research comparable approaches, draft legislation or comments and help organize testimony and coalition advocacy. We examine the responsible agencies, available legal authority and practical requirements for implementation.

For a building-specific agreement, agency negotiation or shareholder issue, our Affordable Housing Cooperatives and HDFC practice addresses the particular transaction or dispute. A development challenge belongs with the community-side Land Use practice.
